Leave Rules - Surrogacy & Commissioning Mother / Father
Both Surrogate Mother and Commissioning Mother, if working in Indian Railways, are eligible for 180 days Maternity Leave from 18.06.2024 onward. (RBE No. 52/2025 – effective from 18.06.2024)
๐ Tip to remember the date: 18 (Date) + 6 (Month) = 24 (Year) → 18.06.2024
Surrogate Mother: A woman who bears a child on behalf of another person or a couple, typically via artificial insemination or in vitro fertilization.
ML stands for Maternity Leave
PL stands for Paternity Leave
Practical Examples:
Situation 1 – Surrogate Mother (the woman who gives birth)
๐ฉ๐ผ Example:
Mrs. Lakshmi, a Railway employee working as a Clerk in the Personnel Department, agrees to carry a baby for another couple (the intended parents). She delivers the baby on 20th July 2024.
✅ Since she is a Railway servant, she is eligible for 180 days Maternity Leave (ML) from the date of delivery (20.07.2024).
❌ However, she cannot take Child Care Leave (CCL), because the baby is not legally hers — she only carried it for the commissioning parents.
Situation 2 – Commissioning Mother (the legal mother)
๐ฉ๐ง Example:
Mrs. Rekha, a Senior Section Engineer in S&T Department, becomes the legal mother of the baby born through surrogacy (baby delivered by Mrs. Lakshmi on 20.07.2024).
✅ Mrs. Rekha is also a Railway servant. Hence, she is eligible for 180 days Maternity Leave from the date she takes the baby in her care (say, 20.07.2024).
✅ She is also eligible for CCL (Child Care Leave) in future, because she is now the legal mother.
Situation 3 – Commissioning Father / Surrogate Father
๐จ๐ง Example:
Mr. Ravi, who is Mrs. Rekha’s husband and works as a Chief Office Superintendent, becomes the legal father of the child born through surrogacy.
✅ He is entitled to 15 days Paternity Leave, to be availed within 6 months from the date of the child’s birth (that is, up to 19.01.2025).
