Rule 21 of Railway Conduct Rules 1966 - Bigamous Marriage - Bilingual

Bigamous Marriage in Railway Service

Rule 21 of the Railway Services (Conduct) Rules, 1966

  • Rule 21(1) bars a Railway servant from marrying a person whose spouse is living.

Example: Railway employee Ravi (unmarried) wants to marry Sita, whose husband is still alive and whose marriage has not legally ended. Not permitted under Rule 21(1).

  • Rule 21(2) bars a Railway servant who has a living spouse from marrying another person.

Example: Railway employee Krishna (married) has a living wife, Harini. He wants to marry another woman, Geetha, without legally ending his first marriage. Not permitted under Rule 21(2).

Exception and Competent authority: The Government may permit an exception only when

  • (a) the marriage is permissible under the personal law applicable to both parties, and

  • (b) there are other grounds for granting permission. Railway Board’s letter dated 10 April 1992 states that proposals are to be sent to the Railway Board; this authority was not delegated to a lower authority. Permission is discretionary; seek it before contracting the marriage.

Separate requirement. Under Rule 21(3) - Marriage with a Foreign National: A Railway servant who marries a person who is not an Indian national must promptly intimate the fact to the Government.

Example: Venkat, an Indian Railway employee, marries Mary, a British citizen, who is not an Indian national. Venkat must promptly inform the Government about his marriage to Mary.

๐ŸŽฏ Examination Focus:

  • Rule 21(3): Marriage with a foreign national.
  • Requirement: Prompt intimation to the Government.
  • Key Point: This is an intimation requirement, not a general requirement for prior permission.

Serving employees and new recruits:

·   Rule 21 directly governs serving Railway servants. The exception is conditional, not an automatic entitlement.

·   Recruitment rules for particular services may separately specify marriage-related disqualifications. Check the relevant notified rules; do not treat Rule 21 alone as the appointment rule for every Railway post.

·   A marital-status declaration may be required under the applicable recruitment or appointment terms. The sources checked do not establish a universal declaration form or automatic dismissal for every recruit. Consequences of an incorrect declaration depend on the applicable rules and appointment conditions.

Examination points

·   Rule 21 — Restrictions regarding Marriage; remember the two separate prohibitions.

·   Exception requires both personal-law permissibility and other grounds; permission is discretionary.
